Course Overview:

Intellectual property is the currency of the tech world.

This Ascend Legal Training covers the fundamental aspects of intellectual property (IP): copyright and related rights, trademarks, patents, geographical indications, and industrial designs. It also covers contemporary issues impacting the IP field such as: new plant varieties, unfair competition, enforcement of IP rights and emerging issues in IP.

Learning Objectives:

The Ascend Legal IP training course offers learners a comprehensive understanding of intellectual property (IP) through a series of sequential modules. They will begin with an introduction to IP, followed by an overview that covers the various aspects of IP. Learners will delve into specific topics such as copyright, related rights, trademarks, geographical indications, industrial designs, patents, new plant varieties, and unfair competition. The course also covers the important area of enforcement of IP rights. Additionally, learners will explore emerging issues in IP, including the intersection of IP and development. Managing IP risks through appropriate Contract terms. By completing this course, learners will have a well-rounded knowledge of IP concepts and be equipped to navigate the complexities of intellectual property in various contexts.

Course Content:

After the Training Program Learners will be able to:

1. Prepare and handle reports and legal opinions on the system of copyright and related rights

Learners will acquire the skills to analyze and evaluate copyright systems, enabling them to prepare comprehensive reports and legal opinions on copyright and related rights.

2. Develop protection strategies for musical works, audio-visual works, photographic works, etc.

Learners will learn strategies to safeguard various forms of creative works such as music, audio-visual content, and photography, including copyright registration and enforcement methods.

3. Understanding the rights of software and database manufacturers

Learners will gain insights into the specific intellectual property rights and protections available for software developers and database creators.

4. Registering Intellectual Property creations

Learners will understand the importance of registering intellectual property assets and the procedures involved in securing legal protection for their creations.

5. Offering protection against violation of exploitation rights

Learners will learn about the different rights held by creators, including reproduction, distribution, public communication, and transformation rights, and how to protect these rights from infringement.

6. Protecting the author’s moral rights

Learners will understand the significance of moral rights in intellectual property, including rights related to disclosure, paternity, and the integrity of the work.

7. Drafting and negotiating contracts for the assignment or exploitation of intellectual property rights

Learners will develop practical skills in contract drafting and negotiation to effectively manage the transfer or licensing of intellectual property rights.

8. Representing and negotiating before Management Entities

Learners will be equipped with the knowledge and skills to engage with management entities such as SGAE, AIE, VEGAP, CEDRO, DAMA, AISGE, AGEDI, and EGEDA, to protect and manage intellectual property rights.

9. Advising on procedures before Management Bodies

Learners will learn the procedures and requirements involved in dealing with management bodies such as SGAE, AIE, VEGAP, CEDRO, DAMA, AISGE, AGEDI, and EGEDA, providing them with the ability to offer informed advice in these contexts.

10. Legal representation before courts or arbitration bodies

Learners will gain an understanding of the legal process and advocacy skills necessary to represent clients in legal proceedings or alternative dispute resolution mechanisms.

11. Negotiating and drafting contracts for the assignment and licensing of exploitation rights

Learners will develop expertise in negotiating and creating contracts that govern the transfer or licensing of exploitation rights, ensuring effective protection and management of intellectual property assets.
